From 3 October, Chinese titanium dioxide enters Kazakhstan without an anti-dumping duty, at least until 10 August 2027.
On 21 September the Board of the Eurasian Economic Commission (EEC) adopted Decision No. 124 on the temporary non-application of the anti-dumping measure on titanium dioxide pigments from China. The decision enters into force 10 calendar days after official publication; the legal portal ppt.ru and Alta-Soft both give 3 October 2026 as the effective date. Kazakhstan is an EAEU member: trade defence measures are set by the Commission and enforced by Kazakh customs.
Who is affected
Titanium dioxide is a basic raw material for paints, plastics, printing inks and paper. Kazakh manufacturers that source the pigment from China see their import costs fall straight away. Chinese producers and traders supplying Kazakhstan should rework their offers accordingly.
How the duty was set up
The measure was introduced by EEC Board Decision No. 96 of 14 October 2025 for five years. It covers pigments containing 80% or more titanium dioxide by dry weight, EAEU code 3206 11 000 0.
Rates depend on the producer: 14.27% of customs value for LB Group and four related companies in Henan, Yunnan, Sichuan and Hubei, and 16.25% for Shandong Dawn Titanium Industry and all other Chinese producers. The six named companies also had approved price undertakings, so no duty was charged when a producer certificate was presented.
Pigments for the food additive E-171, pharmaceuticals and cosmetics were excluded from the start. Decision No. 96 also set annual duty-free volumes: 5,000 tonnes for Kazakhstan, 250 tonnes for Armenia, 4,500 tonnes for Belarus and 300 tonnes for Kyrgyzstan, provided the declarant holds an end-use document issued by the competent authority of its own country.
What Decision No. 124 changes
The decision has four points. First, the measure under Decision No. 96 is not applied from the date of entry into force until 10 August 2027 inclusive. Second, customs authorities in the union do not collect the duty during that period. Third, item 6 of Annex 3 to Decision No. 96 is deleted; that item is the price undertaking of Shandong Dawn Titanium. Fourth, the entry-into-force rule.

The basis was a conclusion by the EEC Department for Internal Market Protection, drawn from information submitted by interested parties in a changed-circumstances review opened by the department director's Order No. 12 of 4 August 2026. The Commission's statement says only that the available information gives grounds to suspend the measure in the interests of EAEU countries.
What companies should do now
One: check declaration dates. The suspension runs from 3 October; goods declared earlier fall under the previous rules. Disputed shipments are best checked with a customs representative in Kazakhstan.
Two: regular import duty and VAT are still payable. Only the anti-dumping duty has been suspended.
Three: the duty-free volume is not needed for now, but keep the paperwork. While the duty is not collected, there is little reason to use the 5,000-tonne quota with an end-use document; the provision remains in Decision No. 96, though, and would apply again if the measure resumes.
Four: build flexibility into long-term contracts. The suspension lasts until 10 August 2027 inclusive, and what happens next depends on the outcome of the review, which has not been published. Supply contracts longer than a year should spell out how prices are revised if the duty changes.
Five: buyers of Shandong Dawn Titanium products should ask for details. The company is no longer on the price undertakings list; that makes little difference during the suspension, but its treatment after any resumption will only be clear once the review is complete.
Not yet published
The Commission has not disclosed the specific reasons for the suspension or a timetable for the review. This article will be updated when the findings are released.
